ETPA Standard Lease Addenda for New Leases and Lease Renewals
The DHCR issued a new standard lease addendum that must be attached to all vacancy and renewal leases for rent stabilized apartments executed on October 1, 2014 or later. This requirement applies to rent stabilized apartments both inside and outside New York City, including those in Westchester County.
Typically, rent stabilized apartments are those apartments in buildings with six or more units built before January 1, 1974 whose rent is less than $2,500 per month and whose tenants are making less than $200,000 per year. Landlords who own rent stabilized units cannot charge rent above the maximum amount permitted under guidelines established annually by local rent guideline boards and are generally required to renew such leases for either one or two year terms.
