Jurisdiction is the authority given by law to a court to try cases and rule on legal matters within a particular geographic area and/or over certain types of legal cases. Jurisdiction requires predicate notice and service, so if notice or service is improper, the court will dismiss the case for lack of jurisdiction.
Nonpayment and holdover proceedings are usually commenced in the local housing or city courts but in some instances can commence, or end up in, Westchester County Supreme Court. The court in which a landlord should commence the action will depend on where the property is located and the type of action being commenced.
