Motion Practice
A motion is a request for relief from the court. Motions are submitted at various stages of a case and for various reasons including permission to file a late claim; requiring the opposing party to disclose information; or a motion to dismiss a claim or the entire case. An Order to Show Cause is similar to a motion but it is time sensitive. To learn more about Orders to Show Cause click HERE.
In landlord-tenant matters, motions are often made by tenants to request more time to pay or cure any defects in order to delay eviction. Motions tend to stall and prolong litigation but it is our goal at James G. Dibbini & Associates, P.C. to resolve cases as quickly as possible for our clients in order to save them time and money. If you have a landlord-tenant matter you need resolved, call our office at (914) 965-1011 and let us help you.
