Notice of Petition and Petition
The Notice of Petition and Petition are legal instruments that signal the start of litigation by bringing the matter into court. It is crucial that these legal documents contain specific information in order to put the tenant on notice. If it does not, the court may dismiss your case. In order to commence the action, the landlord must first pay the appropriate filing fee and then file with the court a Notice of Petition and a Petition to Recover Possession of Real Property that includes a copy of the written demand that was given to the tenant before the action was commenced.
Once filed with the appropriate court and given an index number, the landlord must serve the tenant according to applicable state law with the Notice of Petition and Petition. This puts the tenant on notice to appear in court on a certain date.
