Notice

Typically, a landlord must follow strict procedures in order to remove a tenant from his/her premises. These procedures include serving the correct predicate notices in accordance with stringent service laws. However, there are instances where serving a Notice is not necessary. These situations usually arise if the tenant has used the rental property to engage in illegal or incurable activities. The following are Notices commonly encountered in holdover proceedings:
  • Notice to Cure
  • Notice of Petition and Petition
  • Notice to Vacate
