Unauthorized Occupants
Under New York law, landlords are permitted to limit the total number of people living in an apartment in order to comply with legal overcrowding standards. The amount of people permitted in the rental unit should be included in the lease. If the tenant breaches his/her lease by permitting unauthorized occupants to reside in the unit, the landlord may be able to commence an eviction proceeding. However, the law permits occupancy by certain individuals other than the tenant(s), such as immediate family members, under specific circumstances.
