Yellowstone Injunctions
Applicable only to matters concerning commercial leases in Supreme Court, a Yellowstone injunction allows tenants to prevent the forfeiture of the lease by obtaining an injunction prior to the Notice of Cure expiring and the issuance of the Notice of Termination. This prevents the landlord from terminating the lease when the Notice of Cure expires. Once the injunction is granted, the landlord must wait until the court determines whether the tenant has breached which gives the tenant even more time to cure the alleged default.
